Bell Atlantic Corp. v. Twombly

Bell Atlantic Corp. v. Twombly

"Bell Atlantic Corp. v. Twombly", 127 S. Ct. 1955; 167 L. Ed. 2d 929; 75 U.S.L.W. 4337 (2007), was a decision of the Supreme Court of the United States. "Bell Atlantic" was an anti-trust case that considered § 1 of the Sherman Act. The Court held that § 1 required "a contract, combination, or conspiracy" to restrain trade. Parallel conduct by competitors, by itself, does not meet the requirements of § 1 of the Sherman Act. The Court's opinion has also been read as a departure from the traditional interpretation of Federal Rule of Civil Procedure 12(b)(6) motions to dismiss, creating a stricter standard of a pleading's required specificity.
