Approach the witness

Approach the witness

In a common law jurisdiction, to approach the witness means for an attorney to ask questions to a witness about documentary evidence. [See a similar definition at [http://dictionary.law.com/default2.asp?typed=approach+the+witness&type=3&submit1.x=70&submit1.y=12] ] The lawyer requests the court, that is, the judge, for permission to go up to a witness in the stand with the document. The judge almost always approves the request. The judge retains discretion, however, to deny to the request to avoid badgering the witness.

Approach the witness has also been used, less commonly, to describe a certain writ to apprehend a person in contempt of court. [Legal explanations website: [http://www.legal-explanations.com/definitions/approach-the-witness.htm] (copyrighted material).]

The process can also be used in a law school moot court or mock trial. [ [http://www.duke.edu/web/mocktrial/procedures.doc Duke Law School Moot Court] ]
